Article 1: Fields of Application and Modification of the General Conditions of Sale

These general conditions of sale apply to all orders placed on the boutique.pure-altitude.com website, an e-commerce service published by the company SAS PURE ALTITUDE.
The publisher reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order.

Article 2: Availability of products

Our product offers and prices are valid as long as they are visible on the site, while stocks last.
Upon receipt of your order, we check the availability of the product(s) ordered. In the event of unavailability, we undertake within 14 days from validation of the order either to deliver the ordered product to you or to offer you a similar product at a similar price or to reimburse you by check.

The order validation date corresponds to the date of the order in the case of payment by credit card online or upon receipt of your check when paying by order voucher.

Article 3: Validation of orders and electronic signature (law of March 13, 2000 on electronic signatures.)

Any purchase order signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be called into question within the limits provided for in these general conditions of sale in the same way as the "right of withdrawal" and "out of stock ".

The “double click” associated with the authentication and non-repudiation procedure and the protection of the integrity of the messages constitutes an electronic signature. This electronic signature has value between the parties in the same way as a handwritten signature.

Article 4: Price

Pure Altitude reserves the right to modify its prices at any time but undertakes to apply the current prices which will have been indicated to you at the time of your order, subject to availability on that date.

Our prices are:
• All Taxes Included for deliveries made within the European Union. The VAT collected may be that of the country of origin or that of the country of destination, depending on the provisions of each Member State.
Please note: the VAT refund service for travelers leaving the EU with their goods is not offered by Pure Altitude.

• Excluding taxes for deliveries made outside the European Union. Import duties and taxes, as well as any customs clearance costs, are then due to the local customs authorities, by the recipient of the goods, according to the customs procedures of each country. Pure Altitude declares the actual market value of its shipments. Under no circumstances can the amount of these duties, taxes and fees be claimed from Pure Altitude. It is understood that the customs authorities will contact the recipient, by all means communicated by the customer when ordering. If it is impossible to contact the recipient, or if they refuse to pay customs duties, taxes and fees, the package may be repatriated to Pure Altitude, and the amount of the order will then be refunded to the customer, less the costs. transport costs as well as package repatriation costs.

Title retention clause :
The products remain the property of pure-altitude.com until full payment of the price by Pure Altitude. However, upon delivery, the risks of the delivered goods are transferred to the customer.

Failure to Pay:
Pure Altitude reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.

Article 6: Delivery terms

During inventory periods, the activity of our warehouses is temporarily disrupted. The delivery times usually announced may then be subject to modifications by pure-altitude.com.
Pure-altitude.com cannot be held responsible for the consequences due to a delay in delivery on the part of La Poste, Chronopost, or the Carrier.

General:
Products purchased on boutique.pure-altitude.com are delivered anywhere in the world (with some exceptions). The products are delivered to the delivery address you provided to us during the ordering process. The times indicated are average times and correspond to the processing, preparation and delivery times of your order.
For parcel tracking reasons, it is impossible for us to deliver orders to bases or other army premises.

Delivery time :
Delivery may vary from 4 to 20 working days from validation of your order subject to stock availability (in accordance with article 2) and a maximum of 30 days from receipt of the order form.

This is an average time depending on the destination, shipping method and availability of the item.

Delivery tracking :
Once you have chosen and validated your payment method, you will be assigned an order number - which we advise you to print and keep. Your order is then recorded.

Delivery Methods:
The ordered product is delivered by an independent carrier to the address appearing on the order form.

From package to delivery:
You must check the conformity of the delivered goods at the time of delivery and before signing the delivery note (CARRIER). You must indicate on the delivery note and in the form of handwritten reservations accompanied by your signature any anomaly concerning the delivery (damaged product, etc.). This verification is considered to have been carried out once the buyer, or a person authorized by him, has signed the delivery note.

If the products need to be returned to us, they must be returned within 14 working days of delivery. Any complaint made outside this deadline cannot be accepted. Article 7: Responsibilities

Pure Altitude cannot be held responsible for non-performance of the contract concluded in the event of an unforeseeable event, force majeure, disruption or total or partial strike, particularly of postal services and means of transport and/or communications, flooding, fire. With regard to products purchased to satisfy professional needs, pure-altitude.com will not incur any liability for any indirect damage as a result of this, operating loss, loss of profit, damage or costs, which may arise.
The choice and purchase of a product are the sole responsibility of the customer. The total or partial impossibility of using the products, in particular due to incompatibility of the equipment, cannot give rise to any compensation, reimbursement or questioning of the liability of pure-altitude.com.
In the event of non-delivery of an order or part of an order, you have a maximum of one year (from the date of departure from our warehouses) to protest. Beyond this deadline, we will not accept any claim.

Article 8: Right of withdrawal

In accordance with article L.121-16 of the Consumer Code, the consumer has a period of 14 working days from the date of delivery of their order, to return any item that does not suit them and request the exchange or refund without penalty, except return costs.
To exercise his right of withdrawal, the consumer can also download the standard withdrawal form and return it to Pure Altitude by post or email. The product must be returned in good condition, in its original packaging, and unused.

Return procedure:
You have 14 days from receipt to notify your customer service of your wish to return the product that does not suit you or does not conform to the order.
Return costs in the event of a withdrawal will be your responsibility.
The return costs for a product declared non-compliant with the order or defective on delivery will be covered by pure-altitude.com: we will reimburse you for the preparation and shipping costs as well as the costs of returning the package in based on the original delivery method. Collection will be carried out by a carrier at our expense after agreement with our customer service.
This right of return can only be accepted for complete products, in their original condition (packaging, instructions, etc.) with a copy of the purchase invoice. Items returned incomplete, damaged, damaged or soiled by the Customer will not be taken back.
We undertake to provide you with an exchange, credit or refund within a maximum of 14 days after receipt of the products by us.
No cash on delivery will be accepted for any reason.

Article 9: Guarantees and after-sales service

To benefit from the product warranty, it is imperative to keep the product purchase invoice.
We remind you that you also benefit from the legal guarantee against hidden defects in application of articles 1640 et seq. of the civil code.
